The Chairman referred to bereavement sustained by the Vice-Chair, Councillor Denis Hadley, through the passing away of his mother and to Councillor Bryan Owen whose mother in law also passed away recently.  Those present expressed their sincere sympathy to the members and their families and stood as a token of respect.

Confirmed and signed the minutes of the meeting of the Planning and Orders Committee held on  9 May, 2007 (page ), subject to the following:

 

 

Item 6.4 - 14C92H, Parc Cefni Bodffordd  The Development Control Manager stated that officers felt that condition (02) should be removed from the requirements of the planning permission as matters contained in condition (02) were also included in condition (03).  The officer also referred to a letter from the applicant which was tabled at the meeting.

 

 

 

It was RESOLVED to accept the officer's recommendation and that condition (02) be omitted from the planning permission.

 

 

 

For the record, item 6.15 (41C54A - Four Winds, Star) was considered immediately after item 6.3 and Councillor John Roberts wished it noted that he left the meeting immediately after determination of item 6.15.

SITE VISITS

 

 

 

The report of the Planning Site Visits held on 23 May, 2007 was submitted and confirmed to be a true record, subject to amending the second paragraph on page 2 (site No 2 Cae Cyd, Llanfairpwll) to read "Development Control Manager" instead of the "Highways Development Control Officer".

This application was brought for determination by the Committee as it was alleged that part of the application site includes land within the Council's ownership.  

 

 

 

The officer requested deferral of determination of the application pending consideration of amended plans that reduced the scale of development from 10 to 8 units, the officer expected to be in a position to submit a report to the next meeting.

 

 

 

It was RESOLVED to defer determination of the application for the reason given.

This application was brought for determination by the Committee as it was submitted by the Council and affects land in its ownership.  The officer recommended a site visit to allow member to assess the impact of the proposal on neighbouring properties and their occupants.

This application was brought for determination by the Committee at the request of the local member.  At previous meetings it was agreed to defer determination to allow the applicant to discuss highway issues with relevant officers.  Amended plans remained outstanding and the officer requested further deferral of determination of the application.

APPLICATIONS ARISING

 

 

 

6.1

DEPARTURE APPLICATION

 

 

 

12C66G  DEMOLITION OF EXISTING BUILDING AND ERECTION OF FIVE DWELLINGS, CAFE, PAVILION AND REFURBISHMENT OF THE OLD BATHS, BEAUMARIS

 

 

 

At the meeting held on 5 July, it was decided to visit the site, this took place on 12 July, 2006.  For the record at point 2 of the officer's report (Description of the Proposal) the Development Control Manager stated that residential units "would be accommodated in 'two' storeys" ... and not "three" storeys as indicated in the report.  Four additional letters of objection from Beaumaris Town Council, the Beaumaris & District Chamber of Trade, the Royal Anglesey Yacht Club and CPRW were tabled at the meeting.  

 

 

 

With the Chair's consent, photographs were circulated to members by the local member.  Councillor RL Owen stated that Certificate B had not been served on the adjoining landowner; the Countryside Council for Wales now responded and object to the proposed scale of development and its impact on the AONB; due to bereavement CADW had not responded.  He referred to the history of planning refusals. Under proposal S34 of the Anglesey Local Plan the site is designated for tourism/recreation facility and should not be developed for private residential use.  In 1975 Anglesey Borough Council assured the residents of Beaumaris that the site would continue to be used by the community and this was incorporated into the terms of sale.  The site lies outside the development boundary for Beaumaris and had inadequate parking provision.  The design and mass of development was unsuitable and would detract from the landscape.  A reduced scale of development would be more sympathetic.

 

 

 

Councillor Hefin Thomas found the proposal to be unacceptable on a sensitive shoreline within the AONB, such a highly visible proposal would have a detrimental impact on the castle and surrounding landscape, he proposed refusal of the application.

 

 

 

In response to a question by Councillor Arthur Jones, the Development Control Manager stated that the site was located within the development boundary for the stopped UDP but not allocated for any specific purpose, the site was designated for tourism/recreation purposes under S34 of the Anglesey Local Plan.  Councillor Jones agreed that the proposal would have a detrimental impact on the Menai Straits shoreline and the castle, he also proposed refusal of the application, this was seconded by Councillor Glyn Jones.

 

 

 

Councillor Eurfryn Davies found the officer's detailed report had thoroughly investigated every aspect of the proposal and proposed accepting the report and recommendation of approval, this was seconded by Councillor Arwel Edwards.

6.2

DEPARTURE APPLICATION

 

 

 

17C406  outline application for the erection of a dwelling on land at Cichle Hill, Llandegfan

 

 

 

This application was brought for determination by the Committee at the request of the local member.  At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on 23 May, 2007.

 

 

 

The Development Control Manager referred to a letter of objection tabled at the meeting.

 

 

 

Councillor Eurfryn Davies stated that, in policy context,  this could be supported as it complied with the requirements of HP5 of the stopped UDP; the site was served by a gateway which was in apparent use.  There were in the region of two dozen houses further up the road and Councillor Davies indicated on the OHP the curvature in the road which prevented traffic from speeding.

 

 

 

In response to a question by Councillor Glyn Jones relating to Policy 50, the Development Control Manager stated that Cichle Hill was recognised as a hamlet and cluster in the stopped UDP

 

but not recognised for development in the Local Plan which carries more weight.

 

 

 

In response to a question by Councillor RL Owen the Highways Principal Engineer stated that highways objection was based on poor alignment of the road and visibility at the entrance to the site and at the junction.

 

 

 

During the site visit Councillor Chorlton found the site which adjoined another dwelling would have no detrimental impact; although he did notice a pylon and noted that there was a TPO on the site.

 

 

 

Councillor Arthur Jones referred to response to consultation at part 5 of the officer's report and proposed accepting the officer's recommendation of refusal, this was seconded by Councillor John Roberts.

 

 

 

Councillor Eurfryn Davies proposed approval.

This application was brought for determination by the Committee at the request of the local member.  On 9 May, 2007 the Committee were minded to approve the application, subject to a condition requiring the premises to close by midnight. The reasons given for approval were:

6.4

19C966  ERECTION OF SIX FLATS ON LAND ADJOINING 8 MILLBANK TERRACE, HOLYHEAD

 

 

 

This application was brought for determination by the Committee as the land is owned by the Authority and at the request of the local member.  At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on 23 May, 2007.

 

 

 

In Councillor Hadley's absence, Councillor Cliff Everett stated that they both felt strongly that this application should be refused on the following grounds:

the site was the only remaining green space in the neighbourhood and had the potential of being recognised as an amenity space

 

Ÿ

whilst it was acknowledged there was a social housing need in the area, it was felt that this could be achieved through extending some Council estates and redeveloping brownfield sites

 

Ÿ

Partneriaeth Cybi's objection to the proposal

 

Ÿ

it would be a great loss to both the young and old of the area

 

Ÿ

the nearest play areas were some distance away at Kingsland, Llaingoch or Treseifion Estate itself

 

 

 

Councillor John Chorlton stated that the land had been a community facility for over 20 years and it was expected that the land would be officially recognised as an amenity space in the emerging LDP to improve the environment for local residents.  Eight affordable dwellings had been built nearby, Councillor Chorlton proposed refusal.

 

 

 

Councillor Arthur Jones referred to Planning Policy Wales (2002), and agreed that the land should be kept for the benefit of the local community, he seconded the proposal to refuse.  Councillor Thomas Jones also felt the proposal was unacceptable.

 

 

 

Councillor Eurfryn Davies felt this would address housing need and proposed approval of the application, this was seconded by Councillor Bryan Owen.

 

 

 

Voting was as follows:

6.5      DEPARTURE APPLICATION

 

 

 

30C629  OUTLINE APPLICATION FOR THE ERECTION OF A DWELLING TOGETHER WITH ALTERATIONS TO THE EXISTING ACCESS AND INSTALLATION OF A NEW SEPTIC TANK ON LAND ADJACENT TO TAN Y MARIAN, BRYNTEG

 

 

 

This application was brought for determination by the Committee at the request of the local member.  At the meeting held on 7 March, it was decided to visit the site and this took place on 21 March, 2007. On 9 May members were minded to approve the application contrary to the officer's recommendation.  The reason given for approval was that this would form a sensitive infill.  In accordance with the Council’s Constitution the application was deferred to allow officers to prepare a report on the reasons for approving the application.

 

 

 

The Development Control Manager stated that two additional letters of objection were to hand and one petition with 28 signatories, although no reference to this particular application was made in the petition it being a general objection to departure applications. The validity of the petition was under consideration.  One letter questioned drainage and sewerage provision and the removal of trees.  The recommendation was one of refusal on policy grounds, should the application be approved then issues raised in objection would be further investigated.  

 

 

 

In response to a question raised by Councillor Glyn Jones the Chair stated that it was up to each individual to decide whether or not they had an interest to declare.  

 

 

 

Councillor D Lewis-Roberts found this to form a natural infill and there was a highway gain.  Councillor Lewis-Roberts stated that there was no problem with the septic tank.  The applicant was a local man who worked in agriculture and requested the Committee's support.

 

 

 

Councillor John Chorlton agreed this formed a reasonable natural infill and proposed approval, this was seconded by Councillor Eurfryn Davies.

Mr Richard Eames of the Highways Department declared an interest in this application and left the meeting during consideration and voting thereon.  This application was brought for determination by the Committee at the request of the local member.  At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on 23 May, 2007.  

 

 

 

Councillor John Roberts reminded everyone that the site was in a prominent position in the village and on the main A5 road.

 

 

 

Councillor John Chorlton proposed approval, this was seconded by Councillors RL Owen and Glyn Jones.

 

 

 

It was RESOLVED to accept the officer's report and to approve the application, subject to conditions detailed in the report.

 

 

 

6.7

DEPARTURE APPLICATION

 

 

 

31C134B  OUTLINE APPLICATION FOR RESIDENTIAL DEVELOPMENT AT CAE CYD, LLANFAIRPWLL

 

 

 

Mr Richard Eames of the Highways Department declared an interest in this application and left the meeting during consideration and voting thereon.  This application was brought for determination by the Committee at the request of the local member.  At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on 23 May, 2007.

 

 

 

The Development Control Manager stated that a meeting had taken place between the applicant, the agent and the case officer relating to density of development and surface water provision.  Subsequently a letter was received stating that they were willing to reduce the number of units and in view of this officer requested deferral of determination of the application.

 

 

 

It was RESOLVED to defer determination of the application for the reason given.

 

 

 

6.8

REMAINDER OF APPLICATIONS

 

 

 

39C254B  OUTLINE APPLICATION FOR THE ERECTION OF FOUR DWELLINGS TOGETHER WITH THE CONSTRUCTION OF A NEW VEHICULAR ACCESS AT HAFOD WERN, MENAI BRIDGE

 

 

 

At the meeting held on 6 September, it was decided to visit the site and this took place on 20 September, 2006.  The application had since been deferred pending completion of consultation on technical issues.  

 

 

 

For the record, part 1 of the report (description of the site), the Development Control Manager stated should read that "There were 'detached bungalows'  surrounding on all but the road frontage ..." and not 'houses'.  Two extra letters of objection were to hand bringing the total to 50, together with an additional petition containing 113 signatures bringing this to 190 signatories.  The officer recommended approval, with an additional condition requiring the provision of a safety barrier surrounding the parking provision.

 

 

 

Councillor Keith Evans stated there was strong local opposition as reported upon in the officer's report.  The proposal comprised over development - two dwellings would be more in keeping with the neighbourhood and appropriate for the site not 4.  The site entrance was one of seven within a distance of 200 yards onto one of the main routes on and off the Island.  The scale of development in relation to the size of the site would create surface water problems.

 

 

 

Councillor Hefin Thomas agreed that four dwellings would over develop the site and be out of character with the neighbourhood and proposed refusal.  Councillor Arthur Jones agreed with this.  Councillor Glyn Jones seconded refusal of the application, Councillor Bryan Owen also seconded refusal.

 

      

 

     In response to Councillor Eurfryn Davies' question the Development Control Manager stated that the density of development would be 33 per hectare.

 

      

 

     Councillor RL Owen questioned reaching a compromise and the Chair stated that any decision would be based on developing four units on site.  Councillor RL Owen proposed approval, this was seconded by Councillor Arwel Edwards.

 

      

 

     Voting was as follows:

     42C203  ALTERATIONS AND EXTENSIONS TO 11 GWEL Y DON, PENTRAETH

 

      

 

     This application was brought for determination by the Committee at the Chairman's request.  At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on 23 May, 2007.

 

      

 

     Councillor Hefin Thomas had no objection to the principle of extending the dwelling but felt that this should either be done to the side or rear of the dwelling.  It would have an unacceptable impact on the building line.  He strongly recommended refusal of the application.

 

      

 

     Councillor RL Owen agreed that it would have a detrimental impact on the pattern of development on the estate and proposed refusal.  Councillor Thomas Jones agreed that extending the front of the dwelling was unacceptable.

 

      

 

     Councillor John Roberts questioned the outcome of a similar application on this estate.

 

      

 

     Councillor John Chorlton disagreed with the above and proposed approval, this was seconded by Councillor Bryan Owen.

6.10      DEPARTURE APPLICATIONS

 

      

 

     45C360A  OUTLINE APPLICATION FOR THE ERECTION OF A DWELLING ON LAND AT PEN WAL BACH, PEN LÔN, NEWBOROUGH

 

      

 

This application was brought for determination by the Committee at the request of the local member. At the meeting held on 9 May, 2007, it was decided to visit the site, this took place on  23 May, 2007.

 

 

 

Councillor Peter Rogers stated that there was a substantial number of passing places along the road serving the site with a further three additional passing places being agreed upon recently; the road also served the nature reserve car park.  Pen Lôn was recognised as a 'hamlet and cluster' in the stopped UDP.  Councillor Rogers disagreed with the second paragraph at point 7 (main planning issues) of the officer's report where it stated that 'the proposal in this instance cannot be classed as an infill or acceptable site as it is not immediately adjacent to the developed part of the hamlet being some 94 metres from the nearest property to the north west and some 234 metres to the nearest property to the south east" -  Councillor Rogers stated that the site was 40m from one property and between 40 - 50m from another.

 

 

 

During the site visit Councillor RL Owen found there to be in the region of 17 dwellings along the lane, and felt the area should be considered a "developed" area, he proposed approval.  With a dwelling being refurbished at the end of the road and between 3 and 4 other planning applications granted along the lane, Councillor Glyn Jones seconded approval.

 

 

 

Councillor Arthur Jones found this completely contrary to policies - the site was not within a cluster, he proposed accepting the report to refuse the application, this was seconded by Councillor Hefin Thomas.

7     ECONOMIC APPLICATIONS

 

      

 

7.1     19C251L/ECON  OUTLINE APPLICATION FOR THE ERECTION OF A RETAIL FOOD STORE ON LAND ADJACENT TO KEEGANS & TRAVELODGE SITE, KINGSLAND, HOLYHEAD

 

      

 

     This application was brought for determination by the Committee as part of the site was owned by the Council.

 

      

 

     For the record, the Development Control Manager stated that point 5 (response to consultation and publicity) of the report should read that 2 letters of objection were to hand and not 3.  Although the application had been submitted in outline form it was accompanied by a site location plan.  There was some element of concern regarding parking provision, waste storage facilities and service/delivery vehicles which would be a matter for consideration when detailed plans would be submitted.  The officer requested delegated authority to approve the application subject to satisfactory outcome of issues of concern.

 

      

 

     Councillor John Chorlton stated that whilst it had been long awaited for the site to be developed, there was concern that small local shops would not be able to compete with this convenience store, he proposed refusal, Councillor Glyn Jones agreed with this and added that there were road safety issues, he seconded refusal.

 

      

 

     The Highways Principal Engineer stated that details of parking provision remained outstanding.  In view of this Councillor Hefin Thomas proposed that consideration be deferred, this was seconded by Councillor Eurfryn Davies.

 

      

 

     It was RESOLVED to defer determination of the application for the reason given.

 

      

 

7.2     30C104N/ECON  OUTLINE APPLICATION FOR THE DEMOLITION OF EXISTING BUILDING AND ERECTION OF A THREE STOREY NURSING HOME TOGETHER WITH THE CREATION OF ASSOCIATED CAR PARKING SPACES AT BRYN MEIRION LODGE, BENLLECH

This application was contrary to policies; he reminded members that a similar application was refused in March of this year, the recommendation was one of refusal.  Another unrelated application 5m from the development boundary was refused by the Committee previously - this particular site stood over 200m away from the boundary.

 

 

 

Councillor Glyn Jones stated that the applicant had received permission for a caravan site, that he is the owner of the outbuilding with permission for conversion and he owned a house in Valley which was for sale. Councillor Arwel Roberts noted that the affordable element had been transferred to another site and requested that the application be deferred to enable officers to discuss planning gain with the developers e.g. a contribution towards play equipment in lieu of loss of potential status as amenity land under designation TO14 of the UDP.  Councillor Glyn Jones agreed and proposed deferral.

     Mr Richard Eames of the Highways Department declared an interest in this application and left the meeting during consideration and voting thereon.

 

      

 

     It was reported that this Committee at its meeting held on 7 June, 2002 resolved to approve the erection of three dwellings together with alterations to the existing vehicular access subject to the completion of a Section 106 Agreement to ensure that the estate road and access together with the sewers and drainage pipes serving the development were constructed to an adoptable standard.

 

      

 

     The Agreement itself was recently completed and, in view of the fact that there had been no significant changes in policy since the date of the original resolution to approve, it continued to be the Authority's intention to issue planning permission for the site in line with the original resolution.

 

     In light of current changes to TAN 15 (Wales) (development and flood risk), the Authority reconsulted with the Environment Agency.  In its response, the Agency strongly recommended that the applicant incorporate climate change to the site as required under TAN 15 and that the local authority impose suitable conditions relating to finished floor levels and implementation of compensatory flood storage works.

 

      

 

It was AGREED that the above conditions would be included on any permission granted for the site.

 

      

 

12.2      13C141A  BRON Y GRAIG, BODEDERN

 

      

 

     It was reported that this Committee at its meeting held on 26th July 2006 resolved to approve an application submitted by Cymdeithas Tai Eryri for the erection of 10 dwellings on land at Bron y Graig, Bodedern as a departure from the Local Plan.  The site was to be developed as an exception site for affordable housing and the Welsh Assembly Government confirmed that it had no objection to the approval.  The matter was to progress under conditions only but further to negotiations was now considered that a Section 106 agreement in respect of the 100% affordable housing provision was required.

 

      

 

RESOLVED to reaffirm approval of the proposal but with a Section 106 Agreement rather than conditions.

 

      

 

      

 

      

 

      

 

12.3      30C385B  BRYN TIRION HOTEL RED WHARF BAY 

 

 

 

     Councillors J Arthur Jones and Hefin Thomas  declared an interest in this application and left the meeting during consideration and voting thereon.

 

      

 

     The Head of Development Control reported on correspondence received from the Deputy Clerk to the Llanfair Mathafarn Eithaf Community Council (a copy of which was again tabled at the meeting). The community council stated that they would possibly challenge this Committee's decision to approve the application as the Committee Members had not received a copy of their correspondence dated 21 March, 2007 prior to making a determination on the application and had not had an opportunity to assess its contents.  The officer staterd that the purpose of the report to Committee was to highlight the primary issues which members would need to consider as part of the decision making process.  Members are updated by officers at Committee on issues of relevance which are not covered within reports.

 

      

 

     The officer stated that over the months there had been discussions with the applicant and consultants in order to overcome the issues which were of concern to the members, the community council as well as the local action group.  

 

      

 

     The officer stated that the lengthy letter received from the Deputy Clerk dealt principally with matters in relation to site access and car parking arrrangements as well as jet skis, access for emergency vehicles etc. The written reports and officer's presentations had all dealt with the substance of the Community Council's objections - including matters contained in their letter of 21 March - and this was evidenced in the minutes of the various meetings where this application had been considered.

 

      

 

     The officer referred to the history of this site and two site visits undertaken by members - it would not be practical to report in detail on each representation.  He felt that all issues raised had been given due and fair consideration.

 

      

 

     Councillor Chorlton stated he'd received a copy letter from the Community Council by e-mail. He accepted what the officer said.

 

      

 

     Councillor John Roberts stated that he was aware that the issue of parking had received considerable attention.

 

      

 

     The Chairman indicated that the Committee had given the application over the past few months more than a fair hearing.

 

      

 

     Members AGREED that the correct procedures were undertaken and the application given due and just consideration.

 

      

 

12.4      30C621 LÔN PANT Y CUDYN, BENLLECH

 

      

 

     It was reported that this Committee at its meeting held on 4 April 2007 resolved to refuse planning permission for residential development on the above land.  The applicants indicated that they would proceed to appeal against this decision.  A public inquiry is scheduled for 11 September, 2007 and a statement of case to be submitted by the end of June.  

 

      

 

     It was AGREED that Councillors Arthur Jones and RL Owen, as proposer and seconder, represent the Authority at the appeal.
